Request Your Rights – Ebco Systems Privacy Portal

Welcome to the communication channel specially developed so that YOU, as a DATA SUBJECT, can request your rights, in accordance with the General Data Protection Law ("LGPD") - Law No. 13,709/2018.

We inform you that your requests will be provided at no cost, preferably electronically, through this channel, within the deadlines defined by the LGPD or subsequently regulated by the National Data Protection Authority ("ANPD").

1. What is LGPD?

LGPD is Brazil's General Data Protection Law, established at the federal level by Law No. 13,709/2018, which came into force in September 2020. The purpose of this Law is to establish rules that promote the protection of personal data of individuals, as well as other rights such as freedom and privacy. These rules must be observed and complied with throughout the entire lifecycle of personal data, from the moment the data is collected until its deletion.

2. What is personal data?

Personal data is information related to an identified or identifiable natural person. Examples of personal data include name, address, email, phone number, and CPF (Brazilian tax ID).

3. What is sensitive personal data?

LGPD establishes a special category of personal data, known as sensitive personal data, i.e., data that, especially if used incorrectly, may generate some form of discrimination. The law considers the following as sensitive: personal data about racial or ethnic origin, religious conviction, political opinion, union membership or membership in religious, philosophical, or political organizations, health or sex life data, genetic or biometric data, when linked to a natural person.

4. Who are data subjects?

According to LGPD, a data subject is the natural person (= individual) to whom the personal data being processed refers.

5. Who is the personal data processing officer?

The personal data processing officer, i.e., the person responsible for Data Protection within a company, is the same as the DPO (= Data Protection Officer). Regardless of the nomenclature used, this is the person appointed to act as the communication channel between the company, data subjects, and the National Data Protection Authority (ANPD).

6. Who are the data processing agents?

According to LGPD, personal data processing can be carried out by two processing agents: the controller and the processor. The controller is responsible for making decisions regarding the processing of personal data. Thus, EBCO acts as the Personal Data Controller. The processor is the natural or legal person, public or private, that processes personal data on behalf of the controller. LGPD considers all activities performed during the lifecycle of data within a company as data processing. Under LGPD, the following activities constitute "data processing": collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, deletion, evaluation or control of information, modification, communication, transfer, dissemination, or extraction.

7. What are my rights? And how to request them from EBCO?

Your rights regarding the protection of your personal data are mostly provided for in Article 18 of the LGPD.
